JAKARTA – Jakarta Commercial Court has rejected all aspects of the Suspension of Debt Payment Obligations (PKPU) petition filed by PT Harmas Jalesveva (Harmas) against PT Bukalapak.com Tbk (BUKA).

In this ruling, the panel of judges fully granted BUKA's opposition to the petition.

The judge concluded that the debt claim submitted by Harmas did not meet the simple proof requirements stipulated in Article 8, paragraph (4) of the Bankruptcy Law.

Additionally, the existence of another creditor, the Directorate General of Taxes, as mentioned by Harmas, was not substantiated. In fact, BUKA has no overdue tax debt.

According to BUKA's management, this decision provides legal certainty for the business community and reinforces the company’s commitment to conducting business transparently and responsibly.

"We welcome the panel of judges' decision, which accepted all of our arguments and rejected Harmas' PKPU petition. This shows that the claim against BUKA lacked a strong legal basis," said Kurnia Ramadhana, a member of BUKA’s Executive Committee, in a written statement on Wednesday (26 February).

Meanwhile, BUKA is also pursuing legal action by filing its own PKPU petition against Harmas in the Jakarta Commercial Court.

This petition relates to a lease agreement for office space in the One Belpark building that was not fulfilled as per the agreement.

Additionally, BUKA is demanding the return of a booking deposit and security deposit amounting to IDR 6.46 billion, which has yet to be received.

"We hope the panel of judges will consider our petition objectively and fairly. BUKA remains committed to protecting the interests of the company and our stakeholders," he said. (DK/ZH)
